Automobile racing is a dangerous sport that may cause injury or death. Motor Werks Racing, Inc. makes no warranties expressed or implied as to the suitability of parts or services provided to protect against injury or death. It is the end user/ vehicle owner/ driver’s responsibility to make that determination prior to driving, entering for testing, or competition.
Products/ Libaility: All products should be installed by a qualified technician. By purchasing products, you forever release and discharge Motor Werks Racing, Inc. and their directors, partners, officers, employees, and or affiliates from any liability. Motor Werks Racing, Inc., and their directors, partners, officers, employees, and or affiliates shall not be liable for any consequential, incidental and contingent damages arising from, but not limited to, the sale, installation, or use of its products. Customer shall be responsible in selecting a qualified installer with current liability insurance to cover any damage that may arise through installation of Motor Werks Racing products and/or your vehicle. Notwithstanding any other provision, Motor Werks Racing’s, Inc. maximum combined liability shall be limited to the payment made by the purchaser under this agreement for the specific product that caused alleged damages. Customer accepts these risks and agrees to release Motor Werks Racing, Inc., and their directors, partners, officers, employees, and or affiliates of any and all liability.
By purchasing products or services, you hereby release and forever discharge and hold harmless Motor Werks Racing, Inc., and their directors, partners, officers, employees, and or affiliates (hereinafter, collectively referred to as “Releases”) from any and all liability, claims, demands, and causes of action of whatever kind of nature, either in law or equity, which may thereafter arise from receipt of parts or services herein. You understand and acknowledge that this disclaimer, waiver, consent and release discharges Releases from any liability or claim that may arise as a result of parts or services. You further expressly understand and agree that this disclaimer, waiver, consent and release is intended to be as broad and inclusive as permitted by law, and this disclaimer, waiver, consent, and release shall be governed by and interpreted in accordance with the laws of the State of Georgia.
Refused Shipments: If a shipment is refused and is returned to Motor Werks Racing by the carrier, the client will be billed any return shipment fees as well as the cost to resend the shipment. This includes shipments where the carrier is unable to deliver after multiple attempts.
Damage Claims/Shipment Shortages: The recipient of the shipment must report all damage and loss claims within 24 hours of receipt. Motor Werks Racing will provide all necessary documentation as well as initiate the claim with the carrier. The recipient must keep all packing materials so the carrier can inspect them. Motor Werks Racing accepts zero responsibility for clients and/or their customers who misplaced or discarded the packaging of a damaged shipment. After reporting the loss/damage to Motor Werks Racing, immediately email us pictures of the damaged item(s) and packaging to proceed with the claim.
Shipping & Handling: Motor Werks Racing cannot be held liable for refusal of, delay of, loss of or damage to a shipment of any item. The customer agrees to indemnify Motor Werks Racing for any and all costs, fees and expenses Motor Werks Racing incurs as a result of any violation of any local, state, federal, national or international laws or regulations. Customer agrees to take responsibility for lost packages that were not independently insured or sent without requiring signature. Customer accepts these risks and agrees to release Motor Werks Racing of all liability.

Motor Werks Racing, reserves the right to charge a shipping and handling fee for all orders being shipped from our facility. This fee applies to all purchases and cannot be waived or credited.
A 7% sales tax will be implemented for every purchase made by a Georgia resident. This fee will be charged for products purchased online, over the phone, and/or via email, this fee is required by law, is non-negotiable and non-refundable.
